These Terms of Use govern your use of Nonsense Arcade at nonsensearcade.com (the “Site”), operated by DIGI LLC and published under the Mahkyo brand. By accessing or using the Site, you agree to these Terms.
Eligibility and personal use
Nonsense Arcade is a general-audience free browser arcade. You may access and play its games for your personal, non-commercial use, provided that you follow these Terms and applicable law. The Site does not require an account and does not create a purchase or subscription relationship.
Ownership
Nonsense Arcade, the Mahkyo branding, the games, artwork, code, text, graphics, and other Site content are owned by DIGI LLC, Mahkyo, or their respective licensors. You receive a limited permission to access and play the games for personal use. No ownership or other rights are transferred to you.
Some components may be provided under third-party licenses. Those components remain subject to their applicable license terms.
Except for third-party components subject to their own licenses, all rights not expressly granted in these Terms are reserved.

Availability and changes
The Site and games may change, be interrupted, or be discontinued at any time. We do not promise that they will always be available, error-free, compatible with every device or browser, or preserve local scores or other game progress.
The Site relies on third-party infrastructure and services, including Netlify. Their availability and operation may affect the Site.

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules.

To the extent permitted by law, DIGI LLC, Mahkyo, and their respective owners, personnel, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, game progress, profits, or goodwill, arising from or related to your use of the Site. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
